Green light from the Constitutional Council for the renewable energy law
The law on the acceleration of renewable energies will be able to be promulgated almost as is. The deputies LR and RN, who seized the Constitutional Council a month ago did not win.
In a decision rendered on Thursday, the court found the provisions of eight articles pointed out by referrals from both parties to be constitutional. However, it “automatically” censures eleven other articles which do not change the scope of the bill unduly, most of them as “legislative riders”, that is to say provisions which have no place in the text.

These include several articles which required the submission of a report to Parliament, for example on the evolution of revenue from the fraction collected overseas on energy products or on the thermal regulations of certain buildings. Another invalidated article abolished the prohibition for producers participating in collective self-consumption operations to make it their main professional or commercial activity.
Elected officials who criticized in particular the recognition of imperative reasons of major public interest (RIIPM) for certain projects, a measure intended to limit certain disputes, denouncing a “break in equality” between producers of renewable energies and other energy companies , are therefore at their expense.
The Council notes for its part that the provisions of the law “aim to promote the production of renewable energies and the development of energy storage capacities”, and considers that the legislator has pursued “the objective of the constitutional value of environmental protection”.
